Bu Kullanım Koşulları ("Koşullar"), Kozmik Atlas uygulamasını ("uygulama", "hizmet") kullanımınızı düzenler. Uygulamayı indirerek, kurarak veya kullanarak bu Koşulları kabul etmiş olursunuz. Koşulları kabul etmiyorsanız uygulamayı kullanmayın.

1. Hizmetin Tanımı

Kozmik Atlas, doğum haritası hesaplama ve astrolojik yorumlama sunan bir mobil uygulamadır. Uygulama; doğum haritası, günlük gökyüzü (transit), astrokartografi, sinastri, horary, ilerletilmiş teknikler ve benzeri astrolojik gözlem araçlarını içerir.

Hizmet, astrolojiyi bir bilgilendirme, eğitim ve kendini-tanıma aracı olarak sunar. Sunulan içerik sembolik ve eğitici niteliktedir.

2. Sorumluluk Reddi (Önemli)

• Uygulamadaki tüm astrolojik yorum, hesaplama ve içerikler bilgilendirme, eğitim ve kendini-tanıma amaçlıdır.
• Bu içerikler kehanet değildir; geleceğe dair kesin bir iddia taşımaz.
• Uygulama tıbbi, psikolojik, finansal, yatırım, hukuki veya profesyonel danışmanlık hizmeti vermez ve bu tür tavsiyelerin yerine geçmez.
• Sağlık, para, hukuk, kariyer ve ilişkiler dâhil olmak üzere hayatınızdaki önemli kararları yalnız uygulamadaki içeriğe dayanarak vermeyin; ilgili alanda yetkili bir uzmana danışın.
• Uygulamadaki içeriğe dayanarak aldığınız kararlardan ve bunların sonuçlarından yalnız siz sorumlusunuz.

3. Hesap ve Kullanım

• Uygulamanın temel özelliklerini hesap oluşturmadan (misafir olarak) kullanabilirsiniz.
• Bulut yedeği ve cihazlar arası erişim için isteğe bağlı olarak hesap oluşturabilirsiniz.
• Hesap oluşturursanız, giriş bilgilerinizin gizliliğinden ve hesabınız altında gerçekleşen işlemlerden siz sorumlusunuz.
• Hizmeti yalnız yürürlükteki yasalara uygun ve hukuka aykırı olmayan amaçlarla kullanmayı kabul edersiniz.
• Hizmeti tersine mühendisliğe tabi tutmamayı, kötüye kullanmamayı veya altyapısına zarar verecek şekilde kullanmamayı kabul edersiniz.

4. Abonelik (Kozmik+), Ücretlendirme ve İptal

• Uygulamanın bazı gelişmiş özellikleri Kozmik+ aboneliği ile sunulur.
• Abonelikler Apple App Store veya Google Play üzerinden satın alınır ve ödemeler ilgili mağaza tarafından işlenir. Ödeme bilgilerinizi biz görmeyiz ve saklamayız.
• Abonelik, aylık veya yıllık olarak sunulabilir ve aksini siz belirtmedikçe, ilgili dönem sonunda mağaza hesabınız üzerinden otomatik olarak yenilenir.
• Geçerli fiyatlar uygulama içindeki abonelik ekranında ve mağaza üzerinde gösterilir.
• İptal: Aboneliğinizi istediğiniz zaman, ilgili mağazanın hesap/abonelik ayarlarından iptal edebilirsiniz:
  • iOS: Ayarlar → [Apple Kimliğiniz] → Abonelikler → Kozmik Atlas
  • Android: Google Play → Profil → Ödemeler ve abonelikler → Abonelikler → Kozmik Atlas
• İptal, mevcut faturalandırma dönemi sonunda yürürlüğe girer; devam eden dönem için ücret iadesi, ilgili mağazanın politikalarına tabidir.
• Varsa ücretsiz deneme süresi, deneme bitmeden iptal edilmezse ücretli aboneliğe dönüşür. Ücret iadeleri Apple/Google politikalarına göre yapılır; bu konularda doğrudan ilgili mağazaya başvurmanız gerekir.

5. Fikri Mülkiyet

Uygulamanın tasarımı, metinleri, yorum içerikleri, marka adı ("Kozmik Atlas", "Kozmik+"), logosu ve Sağlayıcının yazdığı yazılım Sağlayıcıya aittir ve telif hakkı ile diğer fikri mülkiyet hakları kapsamında korunur. Bu içerikleri Sağlayıcının yazılı izni olmadan kopyalayamaz, çoğaltamaz, dağıtamaz veya türev çalışmalar oluşturamazsınız.

Uygulama, kendi lisanslarıyla dağıtılan açık kaynak bileşenler içerir. Gök cismi konumları, MIT lisanslı astronomy-engine (Don Cross) kütüphanesinin C kaynağından derlenmesiyle hesaplanır. Bu bileşenlerin hakları kendi sahiplerinde kalır; lisans metinleri uygulamada ve bu alan adında yayımlanır.

Uygulama içinde yazdığınız notlar ve girdiğiniz kişisel veriler size aittir; bu içeriklere ilişkin haklarınızı saklı tutarsınız.

6. Üçüncü Taraf Hizmetler

Uygulama; Supabase (kimlik doğrulama ve bulut yedeği), RevenueCat (abonelik yönetimi), Apple App Store / Google Play (ödeme), Sentry (hata raporlama) ve OpenStreetMap Nominatim (coğrafi kodlama) gibi üçüncü taraf hizmetleri kullanır. Bu hizmetlerin kullanımı kendi koşul ve politikalarına tabidir. Üçüncü taraf hizmetlerin kesintisizliğinden veya hatalarından Sağlayıcı sorumlu tutulamaz.

7. Sorumluluğun Sınırlandırılması

• Uygulama "olduğu gibi" ve "mevcut haliyle" sunulur. Hesaplamaların kesintisiz, hatasız veya her durumda doğru olacağına dair açık ya da zımni bir garanti verilmez.
• Yürürlükteki yasaların izin verdiği azami ölçüde, Sağlayıcı; uygulamanın kullanımından veya kullanılamamasından doğan dolaylı, arızi veya sonuçsal zararlardan sorumlu değildir.
• Astrolojik içeriğe dayanarak alınan kararlar tamamen kullanıcının kendi sorumluluğundadır (bkz. Bölüm 2).

8. Hizmetteki Değişiklikler ve Erişilebilirlik

Sağlayıcı; uygulamanın özelliklerini, içeriğini veya abonelik kapsamını zaman zaman güncelleyebilir, ekleyebilir veya kaldırabilir. Bakım, teknik sorun veya mağaza politikaları nedeniyle hizmette geçici kesintiler yaşanabilir.

9. Fesih

• Hesabınızı istediğiniz zaman silebilir veya uygulamayı cihazınızdan kaldırabilirsiniz.
• Bu Koşulları ihlal etmeniz hâlinde Sağlayıcı, hesabınıza ve hizmete erişiminizi askıya alma veya sonlandırma hakkını saklı tutar.
• Fesih hâlinde, devam eden abonelikler için iade talepleri ilgili mağaza politikalarına tabidir.

10. Koşullardaki Değişiklikler

Bu Koşulları zaman zaman güncelleyebiliriz. Önemli değişiklikler uygulama içinde veya kozmikatlas.com üzerinde duyurulur. Değişikliklerin yayımlanmasından sonra uygulamayı kullanmaya devam etmeniz, güncel Koşulları kabul ettiğiniz anlamına gelir.

11. Uygulanacak Hukuk

Bu Koşullar Türkiye Cumhuriyeti yasalarına tabidir ve bu yasalara göre yorumlanır. Taraflar, doğabilecek uyuşmazlıklarda öncelikle iyi niyetle çözüm aramayı kabul eder.

These Terms of Service ("Terms") govern your use of the Cosmic Atlas application ("the app", "the service"), published in Turkish as Kozmik Atlas. By downloading, installing or using the app you accept these Terms. If you do not accept them, please do not use the app.

This English text is provided for your convenience. The Turkish text above is the governing version; where the two differ, the Turkish text prevails.

1. Description of the Service

Cosmic Atlas is a mobile application that computes natal charts and presents astrological interpretation. It includes the natal chart, the sky of the day (transits), astrocartography, synastry, horary, advanced techniques and comparable astrological observation tools.

The service presents astrology as an informational, educational and self-knowledge tool. The content offered is symbolic and educational in nature.

2. Disclaimer (Important)

• All astrological interpretation, computation and content in the app is for information, education and self-knowledge.
• This content is not divination and carries no definite claim about the future.
• The app does not provide medical, psychological, financial, investment, legal or professional advisory services and is not a substitute for such advice.
• Do not base important decisions in your life, including health, money, law, career and relationships, solely on the content in the app; consult a qualified professional in the relevant field.
• You alone are responsible for the decisions you take based on the content in the app and for their consequences.

3. Account and Use

• You may use the core features of the app without creating an account, as a guest.
• You may optionally create an account for cloud backup and access across devices.
• If you create an account, you are responsible for keeping your sign-in details confidential and for the activity that occurs under your account.
• You agree to use the service only for purposes that comply with applicable law and are not unlawful.
• You agree not to reverse engineer the service, not to abuse it, and not to use it in a way that damages its infrastructure.

4. Subscription (Kozmik+ / Cosmic+), Charges and Cancellation

• Some advanced features of the app are offered through the Kozmik+ subscription, shown as Cosmic+ in English.
• Subscriptions are purchased through the Apple App Store or Google Play, and payments are processed by that store. We neither see nor store your payment details.
• The subscription may be offered monthly or yearly and, unless you state otherwise, renews automatically through your store account at the end of the relevant period.
• Current prices are shown on the subscription screen inside the app and on the store.
• Cancellation: You may cancel your subscription at any time from the account or subscription settings of the relevant store:
  • iOS: Settings → [your Apple Account] → Subscriptions → Kozmik Atlas
  • Android: Google Play → Profile → Payments and subscriptions → Subscriptions → Kozmik Atlas
• Cancellation takes effect at the end of the current billing period; a refund for the period already running is subject to the policies of the relevant store.
• A free trial period, where one is offered, converts into a paid subscription unless it is cancelled before the trial ends. Refunds are handled according to Apple and Google policies, and you need to apply to the relevant store directly for those matters.

5. Intellectual Property

The design, texts, interpretive content, brand names ("Kozmik Atlas", "Cosmic Atlas", "Kozmik+", "Cosmic+"), logo and the software written by the Provider belong to the Provider and are protected by copyright and other intellectual property rights. You may not copy, reproduce, distribute or create derivative works from this content without the Provider's written permission.

The app includes open-source components distributed under their own licences. Celestial positions are computed by astronomy-engine (Don Cross), compiled from its C source under the MIT licence. Rights in those components remain with their authors; their licence texts are published in the app and on this domain.

The notes you write and the personal data you enter inside the app belong to you; you retain your rights in that content.

6. Third-Party Services

The app uses third-party services such as Supabase (authentication and cloud backup), RevenueCat (subscription management), Apple App Store and Google Play (payment), Sentry (error reporting) and OpenStreetMap Nominatim (geocoding). Use of those services is subject to their own terms and policies. The Provider cannot be held responsible for the continuity of third-party services or for errors in them.

7. Limitation of Liability

• The app is provided "as is" and "as available". No express or implied warranty is given that the computations will be uninterrupted, error free or correct in every case.
• To the maximum extent permitted by applicable law, the Provider is not liable for indirect, incidental or consequential damages arising from the use of, or the inability to use, the app.
• Decisions taken on the basis of astrological content are entirely the user's own responsibility (see Section 2).

8. Changes to the Service and Availability

The Provider may from time to time update, add to or remove features, content or the scope of the subscription. Temporary interruptions may occur because of maintenance, technical problems or store policies.

9. Termination

• You may delete your account or remove the app from your device at any time.
• If you breach these Terms, the Provider reserves the right to suspend or terminate your access to your account and to the service.
• On termination, refund requests for subscriptions still running are subject to the policies of the relevant store.

10. Changes to These Terms

We may update these Terms from time to time. Significant changes are announced inside the app or on kozmikatlas.com. Continuing to use the app after the changes are published means that you accept the current Terms.

11. Governing Law

These Terms are governed by and interpreted according to the laws of the Republic of Turkiye. The parties agree to seek a good faith resolution first for any dispute that may arise.
